Harper v. U.S. Dep’t of Interior, et al., 571 F. Supp. 3d 1147 (D. Idaho 2021) (Granting a motion to dismiss as to multiple causes of action and multiple defendants in a
constitutional tort action). An interlocutory appeal was filed as to the one remaining
claim. The U.S. Solicitor General approved the interlocutory appeal and the Ninth Circuit reversed resulting in the termination of the case. See 71 F.4th 1181 (2023).
